Terms and Conditions

JFYP Studio is the trading name of Just For You Photography (SY) Limited – registered at Companies House 08163881 – these are the basic Terms and Conditions

In the following terms & conditions “the photographer” shall mean Andy Harris or other photographers contracted to JFYP Studio as required.

“The client” shall be those persons defined as contracting JFYP Studio for a booking. These terms & conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.

“The event” shall be defined as a studio portrait session, external event (party, event etc), or any such location shoot referred to as a contracted piece of work.

“The photo shoot” shall be defined as any shoot in the studio or on location.

1. Copyright:
The copyright Designs and Patents Acts assign the copyright of the images to the photographer.  JFYP will share those rights with the Clients where agreed (for distribution and printing but NOT for editing, this is an optional extra – please ask for details).

2. Display:
The client hereby allows the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures,magazine articles, websites, sample albums etc unless expressly requested not to by the client.

3. License, Coverage and Reproduction:
Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the clients requirements, especially if requested up front with a picture list. The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer’s judgement regarding these matters shall be deemed correct although the client’s wishes will be fulfilled as much as possible.

The photographer shall endeavour to photograph all individuals as requested by the client at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.

For a booking involving a church ceremony (eg. christening etc) or at certain venues, the photographer’s movements are sometimes restricted by the official(s) in charge. The area from which the photographer is able to cover the event may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.

Due to a variety of lighting conditions and the limitations of digital sensors and camera lenses, some colours may alter throughout a set of photographs, and some photos (especially in poor light conditions) may be grainy.

Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible (liable) for photographs that cannot be produced due to technical failure. This is extremely rare and in some ways the risk is circumvented by use of two photographers at weddings and other big events.

4. Prices
All prices are agreed in advance and provided (where necessary) on quote and receipt forms on JFYP Studio headed paper (usually electronically). These should be checked carefully by the client to ensure they are happy with the contents before the event takes place.  Additional ‘extras’ to the contracted prices will be at the prices prevailing at the time of request and may be higher than the quoted price (quotes are normally valid for up to 90 days (unless otherwise stated), unless a booking for that cost is agreed up front).

5. Payments
If required, a non-refundable booking fee of £50.00 will reserve the date and confirm your booking, as is a full acceptance of the terms and conditions as published on the photographer’s website. The booking fee will be deducted from the cost of the client’s chosen package when calculating the final balance due. This deposit is usually only requested for big events or commercial shoots where a date is fixed in the calendar, and therefore any cancellation means loss of income.

Payments for advance events (such as events, concerts, etc) will be required no later than 10 calendar days before the event, otherwise the event may not be attended by the photographer.

Additional goods ordered must be paid for in full at the time of ordering unless otherwise agreed.

Titles to all goods remains with the photographer until paid for in full by the client(s)

6. Force Majeure
The photographer will endeavour to put the client in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc. Where JFYP have been contracted to supply 2 photographers this will rarely be an issue.

In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund only of any fees paid.

7. Ownership
Unless otherwise stated, all digital negatives (computer files) remain the property of the photographer.  Most products supplied by JFYP are given with limited printing and distribution copyright rights to the clients – this will be made clear on booking form and/or receipt.

Where copyright is given to the client to print or distribute files as they please, it does not imply client has rights to pass on images as if they had taken them themselves. Due recognition to photographer must always be made known if requested of the client.

8. Cancellation Fees

If the client should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:
Cancellation from the booking date and more than one month to go until the event, the fee is £100.00.
Cancellation with less than one month to go until the event/wedding date, 50% of the event/wedding price becomes due.
The client are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.

9. Pre-wedding shoot
The pre-wedding shoot (PWS) is undertaken at the studio unless otherwise agreed. PWS may be actioned outside studio but with small additional charge for travel/time.
The photographer accepts no responsibility whatsoever for damage caused to/by the guest signature board during the wedding day. The signature board is supplied “as is” and all use is at the client’s own risk.

10. Personal Accident and Liability
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot. But if liability is deemed to the photographer, JFYP Studio has public liability insurance in place with Hiscox Insurance Services. Copies of the Liability certificate can be requested..
